I was not wearing a helmet; will this affect my compensation claim?

Not wearing a helmet doesn’t mean that you will not be able to claim compensation. However, failing to wear a helmet can sometimes impact the amount of compensation you receive. This is because there may be a finding of contributory negligence in the case. This basically means that if you are found to have contributed to your injuries as a result of your actions, your compensation may be reduced proportionally to the level you are found to be responsible. Your solicitor will be able to explain this in more detail to you and advise on whether there may be any findings of contributory negligence.
